1. Who we are

Beyond the Ruby Door OS (the "Service") is operated by Beyond the Ruby Door LLC("Beyond the Ruby Door," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms of Service.

2. Acceptance of terms

By accessing or continuing to use the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. You must be of legal age in your jurisdiction to use the Service.

3. The service

Beyond the Ruby Door OS is a software platform for luxury travel advisors, tour managers, and entertainment travel agents that includes client management, trip planning, commission tracking, and related tooling. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan.

4. Account responsibilities

You must provide accurate information when creating your account and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

We retain all right, title, and interest in and to the Service, including all software, documentation, branding, and related intellectual property. You retain ownership of the data and content you submit, and grant us a limited license to host and process that content solely to provide the Service to you.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

Subscriptions begin with a 14-day free trial (a payment method is required to start). After the trial, your subscription will automatically renew at the then-current price for your plan (monthly) until cancelled. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period.

8. Service level

We strive to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or free of security vulnerabilities. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may close your account at any time. Upon termination, you will have a reasonable window to export your data, after which it may be deleted.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

11. Indemnification

You agree to indemnify and hold us harmless from any third-party claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of the United States and the state in which Beyond the Ruby Door LLC is registered, without regard to conflict-of-laws principles.

13. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
